AI, regulation and the lawyer's role

Philippe Nantermod, lawyer and National Councillor, on what AI already changes in legal practice, and what still depends on the lawyer.

In the second episode of Code to Code, the Silex podcast on where the code of law meets the code of machines, Kyriaki Bongard hosts Philippe Nantermod, lawyer in Valais, member of the National Council since 2015 and president of USPI Suisse. Starting from Marc Bonnant's view of the lawyer in Episode 1, they discuss how the profession has always evolved with its tools, from the typewriter to artificial intelligence, what AI can and cannot do for lawyers today, why trainee lawyers still need to read the case law themselves, and why more and more clients arrive at the office with answers generated by AI.

The conversation then turns to regulation. Should Switzerland legislate on AI now, or wait? Should it build its own digital infrastructure? How should professional secrecy adapt to cloud computing and AI? Philippe Nantermod also explains why he believes lawyers should learn to code.

My experience is that AI is a very good legal assistant that can go extremely far in analysing cases, drafting briefs and letters, and in legal research. The lawyer's role is really one of supervision: knowing whether we are taking the right path, whether we are heading in the right direction.
